1. Scope & Acceptance
This Policy applies to every AI-powered capability of the Service. It does not replace the Terms of Service or Privacy Policy; where this Policy is silent, those documents govern. If your organization has a signed agreement with ECSite that addresses AI features, that agreement controls to the extent of any conflict.
2. What the AI Features Are
The AI Features are designed to support your safety program with context from your own data. They include, without limitation:
- Aura Assistant: a conversational assistant in the dashboard and mobile app that answers questions grounded in your organization's forms, incidents, metrics, and Safety Docs, scoped to each user's role and permissions.
- Aura Agents & recommendations: analysis of signals across the platform that surfaces ranked, evidence-backed safety recommendations and briefings.
- Smart Form assistance: auto-filled and conversational form completion (for example weather, location, and suggested hazards on PTPs and JHAs), plus AI review of submissions before approval.
- Hazard identification: analysis of photos submitted by users to flag potential hazards (currently offered in Beta).
- Camera Hub detections: for customers who purchase the Camera Hub add-on, edge-processed analysis of video from your own cameras for compliance events.
Features labeled Beta or Coming soonmay change, may behave unpredictably, and are provided under the No-Charge & Beta provisions of the Terms.
3. Enablement & Controls
AI Features are part of the Service. Account Owners and administrators control how they are used within their organization:
- Administrators may disable specific AI Features for their organization or for specific roles, where the plan provides such controls.
- Aura's answers are grounded on the data visible to the requesting user; it does not expose data a user could not otherwise access.
- Organizations may opt out of optional AI Features at any time, which stops the associated processing described in this Policy.
4. Data Use & Protection
- Customer Data processed by AI Features is handled in accordance with our Privacy Policy and applicable data-protection laws.
- We do not use your Customer Data to train external or public AI models.
- Inputs and outputs are retained as Customer Data under your organization's retention settings; they are not sold or shared for advertising.
- Processing may occur in the United States or other jurisdictions where we or our subprocessors operate; transfers are protected by appropriate safeguards, including data processing agreements.
- We apply the same confidentiality and security controls to AI processing as to the rest of the Service.
5. Third-Party AI Providers
Some AI Features are built on foundation models operated by third-party providers under contracts that restrict how they may use your data (including prohibitions on training their models with your Customer Data). Your use of the AI Features must also comply with the acceptable-use policies of those providers as applicable. A current list of subprocessors is available on request at privacy@ecsiteapp.com.
6. Human Oversight & Safety-Critical Use
ECSafety is decision support for your safety program. It is not a substitute for professional judgment or for your legal duties:
- AI outputs (including recommendations, hazard flags, form suggestions, and camera detections) must be reviewed by qualified personnel before action is taken in reliance on them.
- AI Features do not replace inspections, competent-person determinations, engineering controls, or any obligation under OSHA or other applicable regulations.
- Stop-work, return-to-work, and emergency-response decisions are made by people; the Service records and communicates them but does not make them.
- The absence of an AI alert is never evidence that a condition is safe.
7. Your Responsibilities & Restrictions
In addition to the restrictions in the Terms, you agree that you will not:
- Submit data to the AI Features that you do not have the right to provide, or that infringes third-party rights or violates applicable law.
- Use the AI Features to generate content that is illegal, deceptive, discriminatory, or harmful, or to make automated employment decisions about individuals without human review.
- Attempt to extract, reverse engineer, or replicate the models, prompts, or safety systems underlying the AI Features.
- Use outputs to develop a competing product or to benchmark for a competitor without our written consent.
- Circumvent role-based access, rate limits, or other technical safeguards.
We may suspend access to AI Features for use that violates this Policy, after notice where practicable, as described in the Terms.
8. Inputs, Outputs & Intellectual Property
- Content you submit to AI Features ("Inputs") and the responses generated for you ("Outputs") are treated as Customer Data under the Terms.
- As between you and ECSite, you retain your rights in Inputs and, to the extent permitted by law, Outputs.
- You grant ECSite the license necessary to process Inputs and deliver Outputs, and to use de-identified, aggregated usage data to operate and improve the Service, consistent with Section 4.
- Similar Outputs may be generated for other customers; nothing in this Policy transfers rights in the Service, the models, or the Aura AI brand to you.
9. Accuracy & Disclaimers
AI outputs are probabilistic. They may be incomplete, inaccurate, outdated, or inapplicable to your situation, and they may miss hazards that exist or flag hazards that do not. Except as expressly stated in the Terms, AI Features are provided "as is" without warranties of any kind, and ECSite does not warrant that Outputs will be accurate, complete, or fit for a particular purpose. You are solely responsible for decisions and actions taken in reliance on Outputs.
10. Usage Limits & Availability
We may apply fair-use limits to AI Features (for example rate or volume limits) to keep the Service reliable for all customers, and we may monitor usage for abuse, security, and compliance with this Policy. AI Features may be modified, and Beta features may be changed or withdrawn, as described in the Terms.
11. Changes to this Policy
We may update this Policy from time to time. We will notify you of material changes, and the "Effective" date above will be revised. Continued use of the AI Features after changes take effect constitutes acceptance of the updated Policy.
